A Charlotte County doctor was sentenced to five months in prison Friday for obstruction of an audit, according to a press release from the U.S. Department of Justice.

Dr. John Janick, 73, reportedly lied to a Medicare program integrity contractor auditing the Janick Medical Group. Janick claimed a third-party employer was paying rent for office space utilized by his wife, Lisa McLaren Janick, according to the plea agreement.

The office space, located within the Janick Medical Group practice, was used by Lisa McLaren Janick to improperly access sensitive patient data, which was then used to generate referrals from Dr. Janick to her third-party employer, without regard for medical necessity.

Lisa McLaren Janick previously pleaded guilty to health care fraud charges in a related case. In her plea agreement, she acknowledged her role in falsifying patient records as part of a scheme to create bogus patient referrals for her third-party employer. Her sentencing is scheduled for Oct. 10.

Dr. Janick’s five months in prison will be followed by three years of supervised release. He is also required to pay $118,831.62 in restitution to the Medicare program.
